You may not exploit or distribute the software or proprietary portions thereof through any network, database, commercial product, competing platform, or other distribution system without express written permission from the Institute.
This Agreement will remain in effect while you access or use GeneticEnergetics.com or maintain an account, unless terminated in accordance with these Terms and Conditions.
This Agreement will remain in effect while you maintain a paid subscription or continue to access services governed by this Agreement.
You may terminate a subscription in accordance with the cancellation procedure provided through GeneticEnergetics.com or by contacting the Institute.
Termination of a subscription does not automatically create a right to a refund except where a refund is expressly provided under the applicable refund policy or required by law.

Any refund associated with cancellation will be determined under the refund terms applicable to your purchase and applicable law.

We may take such action when reasonably necessary to protect the Institute, its users, its intellectual property, its systems, or third parties; to enforce these Terms and Conditions; or to comply with applicable law.
If we cancel paid services for reasons unrelated to your breach of these Terms and Conditions, any refund due will be determined in accordance with the terms applicable to the service and applicable law.

The Institute warrants that paid digital services will operate substantially in accordance with the description applicable to the service, subject to the limitations contained in these Terms and Conditions.

Any additional remedies required by applicable law remain unaffected.

Nothing in this provision prevents either party from seeking appropriate injunctive or equitable relief concerning infringement or misappropriation of intellectual property, confidential information, or other rights where such relief may lawfully be sought.
These Terms and Conditions, together with any additional terms expressly incorporated into them or applicable to a particular product or service, constitute the agreement between you and the Institute concerning their subject matter and supersede prior or contemporaneous communications concerning that subject matter.
Nothing in this Agreement transfers ownership of Institute intellectual property to you.
Except for the limited rights expressly granted under these Terms and Conditions, the Institute reserves all rights it possesses in GeneticEnergetics.com, its proprietary content, software, methodologies, systems, educational materials, reports, assessments, research, branding, and other intellectual property.
Third-party intellectual property remains the property of its respective owners.
Neither party will be liable for failure or delay in performance caused by circumstances beyond that party's reasonable control, including natural disasters, fire, flood, earthquake, severe weather, power outages, internet or telecommunications failures, labor disputes, war, terrorism, cyberattacks, governmental actions, regulatory changes, epidemics, pandemics, or failures of third-party infrastructure or service providers.

Third-party trademarks, service marks, copyrighted works, and other intellectual property appearing on or referenced by GeneticEnergetics.com remain the property of their respective owners. Their appearance does not imply ownership by the Genetic Energetics, Inc.
